GENERAL TERMS AND CONDITIONS

(a) This agreement governs your use of Baju Langkawi’s (a product by Ceritera Travel Sdn. Bhd.) site and services, including all orders made or processed for products or services in connection with the site and services which Baju Langkawi’s (Ceritera Travel Sdn. Bhd.) makes available. You and Baju Langkawi (“Ceritera Travel Sdn. Bhd.”), a registered travel agency under Ministry of Tourism and Culture, Malaysia (MOTAC) (“Baju Langkawi”), No. SSM: 201701002998, 1217148-D, No. KPK/L: 8700 that produces a unique Mandarin Collar with Batik or any related cultural print shirt, are the parties to this agreement. If you choose to use other features of the site and services, other terms may apply in addition to those. No exceptions to these terms are effective unless “Ceritera Travel Sdn. Bhd.” has agreed to them in writing.

(b) “Ceritera Travel Sdn. Bhd.” may change these terms from time to time. If “Ceritera Travel Sdn. Bhd.” makes changes to these terms, you will be asked to accept the new terms as a condition of continuing to use “Ceritera Travel Sdn. Bhd.’s” site and services. If you disagree with any amendments, you must stop using “Ceritera Travel Sdn. Bhd.’s” site and services.

Terms and conditions

Use of the Site and Service Generally

(a) “Ceritera Travel Sdn. Bhd.” owns all intellectual property and other rights, title, and interest in and to its site and services (except for user-provided content). Your use of the site and services does not grant you any right, title, or interest to these properties, except as follows. “Ceritera Travel Sdn. Bhd.” grants you a limited, revocable license to access and use the site and services for its intended purpose: the provision of an online, on-demand, customizable merchandising solution. You may only use the site and services according to “Ceritera Travel Sdn. Bhd.’s” terms, rules, and guidelines found on its site, and “Ceritera Travel Sdn. Bhd.” may revoke this license and limit your access to the site and services according to Section 15 (Termination of Access).

 

(b) You may not:

  • interfere with the site and services by using viruses or any other programs or technology designed to disrupt or damage any software or hardware;
  • modify, copy, create derivative works from, reverse engineer, decompile or disassemble any technology used to provide the site and services;
  • use a robot or other automated means to monitor the activity on or copy information or pages from the site and services, except search engines, traffic counters, or similar basic performance monitoring technology;
  • impersonate another person or entity;
  • use any meta tags, search terms, keywords, or similar tags that contain “Ceritera Travel Sdn. Bhd.’s” name or trademarks;
  • engage in any activity that interferes with another user’s ability to use or enjoy the site and services, including activity that places a disproportionate burden on the site and services compared to ordinary use from a single, ordinary user;
  • assist or encourage any third party in engaging in any activity prohibited by this agreement; or
  • use the site and services to promote hate speech, obscenity, or any content that violates “Ceritera Travel Sdn. Bhd.’s” Ethical Guidelines, which “Ceritera Travel Sdn. Bhd.” may change from time to time at “Ceritera Travel Sdn. Bhd.”s” sole discretion.

 

Shops

You can shop for our products via online at www.bajulangkawi.asia. Alternatively, we are also available at physical stores in Langkawi International Airport, Penang International Airport, Kuala Lumpur International Airport 1, Kuala Lumpur International Airport 2, Kuching International Airport and Kota Kinabalu International Airport in a shop called “Sense of Malaysia”. If you have any questions, please contact our customer service for help at admin1@ceriteratravel.com or bajulangkawi@gmail.com. All merchandise remains our property until payment is fulfilled. Any attempts of fraud will be reported to the police. “Ceritera Travel Sdn. Bhd.” reserves the right to cancel, hold on to, or further investigate an order at suspicion, even if delivery time is affected. “Ceritera Travel Sdn. Bhd.” holds the right to have minor deviations related to how material, color, weight, measurements, or manufacturing, appear on our online shop. This also includes type faults, price, and stock changes. All prices exclude the goods and services tax (GST) rate which is 6%. GST will be included when the delivery area is in Malaysia, except: Langkawi, Labuan, and Pulau Tioman.

 

Product Sales

  1. By placing an order using “Ceritera Travel Sdn. Bhd.’s” site and services, a customer makes a binding offer for a contract of sale or, as the case may be, a contract for work and materials with “Ceritera Travel Sdn. Bhd.” only (no contract exists between the customer and any applicable shop owner). “Ceritera Travel Sdn. Bhd.” sends an order confirmation via e-mail to the customer. The order confirmation is not an acceptance of the offer, but only acknowledges that the order was received. The offer is only accepted when “Ceritera Travel Sdn. Bhd.” confirms that production has been completed in a second e-mail. “Ceritera Travel Sdn. Bhd.” cannot guarantee the continued availability of any products or designs found on its site.
  2. Information, drawings, figures, technical data, specifications of weight, measurements, and services contained in catalogues, ads, or price lists are purely informational “Ceritera Travel Sdn. Bhd.” cannot guarantee the correctness of this information, and if there is any inconsistency between the information described above and the information in an order confirmation email, the order confirmation email controls.
  3. “Ceritera Travel Sdn. Bhd.” reserves the right to reject orders for any reason or no reason. If GENZS Solution rejects an order, it will notify the customer.
  4. “Ceritera Travel Sdn. Bhd.’s” performance of an order is completed when the shipment provider completes delivery to the customer’s address, according to the records of the shipment provider. If there is an interruption of delivery, and “Ceritera Travel Sdn. Bhd.” cannot replace the order in a reasonable amount of time, “Ceritera Travel Sdn. Bhd.” will notify the customer immediately.
  5. If there is a product defect or if you are dissatisfied with your order for any reason, “Ceritera Travel Sdn. Bhd.’s” return policy will apply unless defect are caused by courier companies which we have no liability to, which “Ceritera Travel Sdn. Bhd.” may change at any time in its sole discretion.

 

Delivery & Shipment

  1. “Ceritera Travel Sdn. Bhd.” warrants that it will ship orders within three days after orders are placed. Normally, goods are shipped within a few days and typical delivery times are 2-4 days, but in certain circumstances, shipment and delivery can take up to three weeks. Customers and “Ceritera Travel Sdn. Bhd.” may separately agree to more specific delivery times and terms in a separate writing or agreement (such as a request for express shipping).
  2. “Ceritera Travel Sdn. Bhd.” will make delivery using a shipment service provider of its choosing. The customer must pay standard shipping costs which may depend on order value and shipping destinations. Shipping costs are displayed at checkout.

 

Payment

  1. Customers may choose to pay by Direct Bank Transfer, ToyyibPay, Online Banking/ Credit Card/ Direct Debit, or other payment methods. “Ceritera Travel Sdn. Bhd.” reserves the right to limit the method of payment chosen by the customer depending on order value, shipment destination, or other objective criteria.
  2. If the customer selects a payment method or provides payment information that makes it impossible or impractical for “Ceritera Travel Sdn. Bhd.” to receive payment (for example, the customer’s account lacks sufficient funds, or the customer provided incorrect payment information) through no fault of “Ceritera Travel Sdn. Bhd.’s” own, the customer agrees that “Ceritera Travel Sdn. Bhd.” may add an additional charge to the order to recoup costs associated with the processing or attempting to process the impossible or impractical transaction.
  3. “Ceritera Travel Sdn. Bhd.” may sub-contract third parties to process payment.
  4. If the customer fails to pay, “Ceritera Travel Sdn. Bhd.” may assign its claims to a debt collection agency and transfer the personal data required for collecting payment to these third parties.

 

Returns & Refunds

For any reason you are not satisfied with your product, please contact us within 7 days from receipt of your order and explain to us what has gone wrong. Returns will not be accepted after 7 days or if they have been worn or washed incorrectly. Returns are not accepted if it caused by courier companies.

Items purchased online can be refunded in one of the following ways:

  1. Items purchased online can be refunded once the customers do not receive the item within 30 days.
  2. Item purchased online can be refunded once the item purchased was out of stock.
  3. Any worn, soiled, altered, washed, or customer-damaged items cannot be returned and will be shipped back to you at your cost, and no refund issued.

If you request a refund, the purchase price will be refunded to you using the original payment method.

 

Title to Products

Until “Ceritera Travel Sdn. Bhd.” receives full payment for an order and the order is shipped, the title to the goods remains with GENZS Solution. Upon transfer of the goods to the carrier, title, and risk of loss pass to the customer. The customer should handle products with care until the transfer of ownership is complete (for example, in case of a product return)

 

User Representations and Warranties; “Ceritera Travel Sdn. Bhd.’s” Right to Refuse Performance

  1. If you upload designs or make changes to products in any way (for example, adding custom text), you represent and warrant to “Ceritera Travel Sdn. Bhd.” that you have all necessary rights (for example, in trademark, copyright, privacy rights, publicity rights, common law, etc.) to use the text or design without violating the rights of any third party. “Ceritera Travel Sdn. Bhd.” may, in its sole discretion, refuse to deliver you the shirt. However, “Ceritera Travel Sdn. Bhd.” is not obligated to review any of your submissions.
  2. You agree to (a) indemnify and (b) release “Ceritera Travel Sdn. Bhd.” from all liability (including costs and attorney’s fees) for claims relating to the alleged or actual infringement of any third-party rights and any law to the extent that such claims relate to your use of “Ceritera Travel Sdn. Bhd.’s” site and service. If you are a shop owner with “Ceritera Travel Sdn. Bhd.”, “Ceritera Travel Sdn. Bhd.” may offset amounts in your shop owner account to satisfy the indemnification payments owed according to this paragraph.

 

Disclaimers

  1. You agree that “Ceritera Travel Sdn. Bhd.” has no responsibility for any damages suffered by you in connection with the site and services, and that use of the site and services, including all content, data, or software distributed by, downloaded, or accessed from or through the site and services, is at your sole risk. You understand and agree that you will be solely responsible for any damage to your business or your computer system or any loss of data that results from your actions and your use of the site and services. “Ceritera Travel Sdn. Bhd.” does not control or endorse in any respect any information, products, or services offered by third parties through the site and services, and is not responsible for any possible representations and warranties these third parties may make.
  2. Due to normal changes in our industry and in our technical production processes, “Ceritera Travel Sdn. Bhd.” may reasonably deviate from the descriptions and information found in its catalogues, and other documents with respect to material, color, weight, measurements, and design, or other features.
  3. “Ceritera Travel Sdn. Bhd.” may use subcontractors or third parties to provide certain elements of its site and services. You agree that “Ceritera Travel Sdn. Bhd.” will not be liable to you in any way for your use of these services.

 

(a) Applicable law

These Terms and Conditions and all disputes arising in connection with these Terms and Conditions or with the use of the website or with any purchase on the website shall be governed by Malaysian Law. “Ceritera Travel Sdn. Bhd.” may modify or amend these Terms and Conditions at any moment. You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.

 

(b) Ownership of right

All rights, including copyrights at genzssolution.com remain with “Ceritera Travel Sdn. Bhd.” and its subsidiaries. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission.

 

(c) Privacy Policy
